I have worked for the same company my first and only job for 10 years. Six years ago I was asked to work afternoons. I had always been non exempt I have never been told what this means, just that I have to write in the hours on timecard. So for the last 10 years I have been writing in the hours on my time card and 6 years ago I began to receive shift differential 10% because of my new hours. But since the beginning of 2009 the hospital stopped paying me the S10% and said that they made a mistake that I had been exempt for the last 6 years so they will no longer pay me the S10% and they will be kind enough not to charge me for all the money they paid me thru the years. Nobody ever told me I was exempt. Is there anything I can do?
